Terms of Service

Effective August 10, 2026

These terms are an agreement between you and Memory Capsule (“we”). By creating an account or using the service, you agree to them. If you don’t agree, please don’t use the service.

Your account

You must be at least 13 years old to use Memory Capsule. You are responsible for your account and for keeping your sign-in method secure. Provide accurate information and let us know if you believe your account has been compromised.

Your content stays yours

You own the photos, videos, recordings, and writing you put into Memory Capsule. You grant us only the limited license we need to operate the service for you: to store, process (for example, generating thumbnails, transcripts, and rendered Guided Memory videos), and display your content to you and to the people you choose to share it with. This license ends when you delete the content or your account, except for the short period needed to purge backups.

Sharing other people's likenesses

Memory Capsule is built around family photos, which means photos of other people. Only upload and share content you have the right to share, and only tag or identify people with their permission. Tag suggestions on a photo take effect only when the photo’s owner accepts them, and face features exist solely to help your family organize its own memories.

Acceptable use

You agree not to use the service to:

  • upload content that is unlawful, infringing, or abusive;
  • harass, impersonate, or violate the privacy of others;
  • attempt to access accounts or data that aren’t yours;
  • interfere with or disrupt the service.

You can report content or block people directly in the app. We review reports promptly and may remove content or suspend accounts that violate these terms.

Paid features

Some features may require a paid plan. Pricing and inclusions are shown before you pay, and purchases made through the App Store are governed by Apple’s terms as well.

Our property

The Memory Capsule name, design, and software are ours and are protected by intellectual-property law, including pending patent applications covering commentary and Guided Memory technology. These terms don’t grant you rights in any of that beyond using the service.

Ending things

You can stop using Memory Capsule and delete your account at any time. We may suspend or terminate accounts that violate these terms. On deletion, your content is removed as described in the Privacy Policy.

Disclaimers

The service is provided “as is.” We work hard to keep your memories safe, but we can’t promise uninterrupted or error-free operation, and we encourage you to keep your own copies of irreplaceable originals. To the fullest extent permitted by law, our liability is limited to the amount you paid us in the twelve months before a claim.

The legal frame

These terms are governed by the laws of the State of California. If we make material changes, we’ll update this page and note the new effective date. Questions: hello@memorycapsule.app.
